ACCESS TO INFORMATION AND PROTECTION OF PRIVACY

In 1996, the Northwest Territories Legislative Assembly passed the Access to Information and Protection of Privacy Act, the (Act). The Act demonstrates the government’s commitment to providing open, accessible and accountable government.  The Act gives individuals a legal right to request access to information held by Northwest Territories public bodies. Information may only be withheld if it falls under one of the limited and specific exceptions set out in the Act.

The Act also provides for the correction and protection of personal information collected, used and disclosed by public bodies. It gives the individual to whom the information relates, the right to access and correct this information. It also sets the conditions for when a public body may collect, use and disclose personal information.

The Act complements other ways of obtaining government information. It is intended to be used as a last resort and does not limit or replace existing procedures for accessing government information or records.

TYPES OF REQUESTS

non- Access to Information and Protection of Privacy (ATIPP) requests or enquiries for information; andThere are two (2) methods for gaining access to records:

  • formal ATIPP requests.

For our purpose, a non-ATIPP request is defined as a Routine Disclosure

ROUTINE DISCLOSURE 

A record that does NOT contain sensitive and/or third party information may be released outside of the formal ATIPP process as requested by the Client, or by an Applicant on behalf of the Client, with the Clients’ written consent.

Records that may be released by YHSSA as a Routine Disclosure include:

  • Medical Records
  • Immunization Records

ATIPP REQUEST

A formal process, defined under the Act, which provides an individual and/or entity the right to request access to records that are in the possession of or under the control of a public body.

Personal Information Request - Information about an identifiable individual, including:

(a)     the individual’s name, home or business address or home or business telephone number,

(b)      the individual’s race, colour, national or ethnic origin or religious or political beliefs or associations,

(c)      the individual’s age, sex, sexual orientation, marital status or family status,

(d)      an identifying number, symbol or other particular assigned to the individual,

(e)      the individual’s fingerprints, blood type or inheritable characteristics,

(f)       information about the individual’s health and health care history, including information about a physical or mental disability,

(g)      information about the individual’s educational, financial, criminal or employment history,

(h)      anyone else’s opinions about the individual,

(i)       the individual’s personal opinions, except where they are about someone else. 

Third Party Request - Any individual, group of individuals or company other than the applicant or a public body is considered to be a third party. When a request for information includes information that affects the personal or business interests of a third party, those interests must be considered before the information can be released.

FEES

The Yellowknife Health and Social Services Authority (YHSSA) may recover costs from the applicant for provision of any information required as set out in the Act.  Once information is retrieved, YHSSA shall contact the applicant and advise the applicant of the fee.  Payment is required prior to release of information.     

Applicants are subject to payment as follows:

ROUTINE DISCLOSURE

Routine Disclosures will be charged a fee of $0.25 per page for preparation and copying of documents.  This fee will only be charged if the total amount due is greater than $25.00 (or more than 100 pages).  Where the total cost is less than $25.00 (or less than 100 pages) no charges shall apply. 

ATIPP REQUEST

Personal Information Requests will be subject to a fee of $0.25 per page for preparation and copying of documents.  This fee will only be charged if the total amount due is greater than $25.00 (or more than 100 pages).  Where the total cost is less than $25.00 (or less than 100 pages) no charges shall apply.

Third Party Requests will be subject to an initial fee of $25.00 in accordance with the ATIPP Act.  In addition, there will be a charge of $0.25 per page for preparation and photocopying of documents as well as a $20.00 fee for shipping.

YHSSA includes the communities of Dettah, Fort Resolution, Lutsel K’e, N’dilo and Yellowknife.  A Directory of Records is available for viewing. The directory describes records held by YHSSA.

To obtain information, please fill out the Consent for Release of Information Form, provide copies of identification and forward to:

“OUT OF PROVINCE/TERRITORY” OR “NWT WIDE”

YHSSA does not obtain “Out of Province/Territory” or “NWT Wide” medical records on behalf of the client, with the exception of Dettah, Fort Resolution, Lutsel K’e, N’dilo.

Should you require a copy of your medical record, please contact your previous medical service provider or NWT Health Authorities and make arrangements to have your medical record delivered directly to:
